1. Acceptance of These Terms

These Terms and Conditions (“Terms”) govern your access to and use of sproutrecovery.com and any related pages, forms, or communications operated by Magdan LLC, a Florida limited liability company doing business as Sprout Recovery (“Sprout Recovery,” “we,” “us,” or “our”), collectively the “Site.”

By accessing the Site, submitting a form, requesting information, or opting in to receive communications from us, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms apply to your use of the Site. They do not replace or modify any admission agreement, consent to treatment, financial responsibility agreement, or other document you sign as a client of Sprout Recovery. Where a signed clinical or admissions document conflicts with these Terms, that signed document controls.

2. About Sprout Recovery

Sprout Recovery is the business name under which Magdan LLC, a Florida limited liability company, operates a licensed behavioral health treatment program in Fort Myers, Florida.

We provide mental health and substance use disorder services, which may include:

  • Partial Hospitalization Program (PHP)
  • Intensive Outpatient Program (IOP)
  • Day Treatment Program
  • Sober Living support in connection with our clinical programs
  • Medication Management
  • Individual Therapy
  • Group Therapy and Support Groups
  • Neurofeedback Therapy
  • Transcranial Magnetic Stimulation (TMS)

Availability of any particular program or therapy is subject to clinical assessment, licensure, capacity, and admission criteria. 

3. Medical Emergencies

The Site is not a crisis service and is not monitored in real time.

If you or someone you know is experiencing a medical emergency, a mental health crisis, thoughts of suicide, or a life-threatening situation, do not use this Site to seek help. Call 911 immediately, or call or text 988 to reach the Suicide and Crisis Lifeline, or go to your nearest emergency room.

Do not use web forms, email, or text messaging to communicate emergencies. We cannot guarantee that any message will be read or responded to promptly.

4. No Medical Advice; No Provider-Patient Relationship

The content on this Site — including pages describing conditions, treatments, therapies, blog articles, and answers to frequently asked questions — is provided for general informational and educational purposes only.

This content is not medical advice, a diagnosis, or a treatment recommendation, and it is not a substitute for consultation with a qualified healthcare professional. Always seek the advice of your physician or another qualified provider with any questions you have about a medical or behavioral health condition. Never disregard professional medical advice or delay seeking it because of something you read on this Site.

Using this Site, submitting a form, or contacting us does not create a provider-patient relationship. A provider-patient relationship is established only after you complete an intake process, are clinically assessed, are formally admitted to a program, and execute the applicable consent and admission documents.

5. No Guarantee of Results

Recovery outcomes vary from person to person and depend on many factors outside our control, including individual medical history, co-occurring conditions, level of engagement in treatment, and circumstances after discharge.

Nothing on this Site constitutes a promise, guarantee, or warranty of any particular clinical outcome, recovery, symptom improvement, or continued abstinence. Any statistics, testimonials, or success stories reflect individual experiences and are not a prediction of your results.

6. Statements Regarding Specific Therapies

Where the Site describes a therapy or device as FDA-cleared, that statement refers to clearance for a specific indication and patient population as determined by the U.S. Food and Drug Administration. FDA clearance does not mean the therapy is appropriate for every individual, that it will be effective for you, or that it is covered by your insurance plan.

Clinical suitability for any therapy, including TMS and neurofeedback, is determined solely by a qualified clinician following individual evaluation.

7. Eligibility and Age Requirements

The Site is intended for use by individuals 18 years of age or older. By using the Site or submitting information through it, you represent that you are at least 18, or that you are a parent or legal guardian submitting information on behalf of a minor for whom you have legal authority to act.

Program admission criteria, including minimum age for specific levels of care, are determined separately during clinical assessment.

8. Text Messaging (SMS) Terms

8.1 Program Description

Magdan LLC, doing business as Sprout Recovery, offers an optional SMS messaging program. Messages are sent under the brand name Sprout Recovery.

If you opt in, you may receive text messages from Sprout Recovery relating to admissions inquiries, appointment scheduling and reminders, program information, insurance verification follow-up, and — where you have separately consented — general updates and educational information.

8.2 How You Opt In

You may opt in to receive text messages from Sprout Recovery by:

  • Checking the SMS consent box on a form on this Site;
  • Providing your mobile number and express written consent during a phone or in-person conversation with our admissions team; or
  • Texting a designated keyword to one of our published numbers.

Consent is not a condition of receiving treatment, admission, or any other service from Sprout Recovery. Consent boxes on our forms are never pre-checked and are never required in order to submit a form. Consent for appointment and treatment-related messaging is collected separately from consent for promotional or informational messaging.

8.3 Message Frequency and Cost

Message frequency varies based on your interaction with us and the type of messages you have consented to receive.

Message and data rates may apply. Sprout Recovery does not charge for text messages, but your mobile carrier’s standard messaging and data rates will apply according to your plan. Please contact your wireless provider for details about your plan.

8.4 Opting Out

You may cancel the SMS program at any time by replying STOP to any message you receive from us. After you send STOP, we will send a single confirmation message and you will no longer receive text messages from that program. If you wish to rejoin, you may opt in again using any of the methods described above.

8.6 Mobile Information and Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of information sharing described in our Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with, sold to, or transferred to any third party, affiliate, or lead generator under any circumstances.

Mobile numbers and SMS consent data are used solely to operate the messaging program described in these Terms. Vendors that process messages on our behalf act strictly as service providers under contract and are prohibited from using this data for their own purposes.

8.7 Message Content and Confidentiality

Standard text messaging is not a secure or encrypted channel. Do not send protected health information, clinical details, medication information, or other sensitive information by text message. Messages we send are intentionally limited in content and will not disclose diagnosis, treatment details, or admission status.

If you would prefer to communicate through a more secure channel, contact us at (239) 402-7152 and we will accommodate reasonable requests.

8.8 Delivery and Carrier Liability

Delivery of text messages is subject to effective transmission by your mobile carrier and is outside our control. Mobile carriers are not liable for delayed or undelivered messages.

We are not responsible for messages that are delayed, undelivered, or received by an unintended party due to an incorrect number, a reassigned number, or a shared device. You agree to notify us promptly if your mobile number changes or is no longer under your control.

9. Email and Telephone Communications

By providing your email address or telephone number, you consent to receive communications from Sprout Recovery at that address or number regarding your inquiry.

Email is not a secure channel. Do not transmit protected health information, clinical details, or other sensitive information by email. You may unsubscribe from non-essential email communications at any time using the link in any message or by contacting us directly. Communications necessary to your care or admission may continue after you unsubscribe from marketing messages.

Calls to and from Sprout Recovery may be recorded or monitored for quality assurance and training purposes. Where recording occurs, you will be notified at the start of the call.

10. Information You Submit

When you submit a form, request a consultation, or contact us through the Site, you agree that the information you provide is accurate, current, and complete, and that you have the legal authority to provide it.

Information submitted through the Site is used to respond to your inquiry, determine whether our services may be appropriate for you, and, where applicable, begin the admissions process. Our handling of that information is described in our Privacy Policy and, once you become a client, in our Notice of Privacy Practices.

Information submitted through a public web form is not transmitted through a secure clinical channel. Please limit web form submissions to the information necessary to make contact.

11. Insurance and Payment

Any statement on the Site regarding insurance acceptance, in-network status, or coverage is general information only and does not constitute verification, pre-authorization, or a guarantee of benefits.

Coverage is determined solely by your insurance plan and is subject to your policy terms, deductible, medical necessity review, and authorization requirements. A benefits verification performed by our admissions team is an estimate based on information provided by your carrier and is not a guarantee of payment. You remain financially responsible for services not covered by your plan, as set out in the financial agreement you sign at admission.

12. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to any portion of the Site, our servers, or any connected system;
  • Introduce malware, viruses, or other harmful code;
  • Use automated tools to scrape, harvest, or index the Site except as permitted by our robots.txt file;
  • Submit false, misleading, or fraudulent information;
  • Submit another person’s information without their authorization;
  • Use contact information published on the Site to send unsolicited commercial messages;
  • Interfere with the operation of the Site or its availability to other users.

We reserve the right to restrict or terminate access to the Site for any user who violates these Terms.

13. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, video, program descriptions, and the Sprout Recovery name and marks — is owned by Sprout Recovery or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.

You may view, download, and print Site content for your personal, non-commercial use. You may not reproduce, republish, distribute, modify, or create derivative works from Site content without our prior written permission.

Third-party names, marks, and devices referenced on the Site are the property of their respective owners and are used for identification purposes only. Their use does not imply endorsement.

14. Photographs and Depictions

Photographs of our facility on this Site depict Sprout Recovery’s actual location. Any image used for illustrative purposes that does not depict our facility, staff, or clients is identified as such. Individuals appearing in photographs are not necessarily clients of Sprout Recovery.

15. Testimonials and Reviews

Testimonials appearing on the Site are provided by individuals who have given written authorization for their use. Testimonials reflect the individual experience of the person providing them and are not representative of the experience of every client. They are not a guarantee, warranty, or prediction of outcome.

Testimonials are not compensated unless otherwise disclosed.

16. Third-Party Links and Resources

The Site may link to third-party websites, resources, or tools that we do not own or control, including social media platforms, external forms, and informational resources. These links are provided for convenience only.

We do not endorse and are not responsible for the content, accuracy, privacy practices, or availability of any third-party site. Your use of a third-party site is governed by that site’s own terms and privacy policy.

17. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

If you become a client of Sprout Recovery, our use and disclosure of your protected health information is governed by our Notice of Privacy Practices and by applicable federal and Florida law, including HIPAA, the HITECH Act, and where applicable, the federal confidentiality regulations governing substance use disorder patient records at 42 C.F.R. Part 2.

18. Accessibility

19. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Sprout Recovery disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, secure, error-free, or free of harmful components.

We do not warrant that Site content is complete, current, or accurate at all times. Clinical information changes, and Site content may not reflect the most recent developments.

20. Limitation of Liability

To the fullest extent permitted by Florida law, Sprout Recovery and its owners, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Site, including loss of data, loss of profits, or damages resulting from reliance on Site content — even if we have been advised of the possibility of such damages.

Our total aggregate liability arising from your use of the Site will not exceed one hundred dollars ($100.00).

Nothing in this section limits liability for professional services rendered to clients of Sprout Recovery, for personal injury caused by our negligence, or for any liability that cannot be limited or excluded under applicable law.

21. Indemnification

You agree to indemnify and hold harmless Sprout Recovery and its owners, officers, employees, contractors, and agents from any claim, demand, loss, or expense, including reasonable attorneys’ fees, arising out of your violation of these Terms, your misuse of the Site, or your submission of information you were not authorized to provide.

22. Changes to These Terms

We may revise these Terms at any time. The revised version takes effect when posted to this page, and the “Last Updated” date will be changed accordingly. Your continued use of the Site after a revision constitutes acceptance of the updated Terms.

Material changes to the SMS program terms will be communicated to enrolled participants before taking effect.

23. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws provisions. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Lee County, Florida, and you consent to the jurisdiction of those courts.

24. Severability and Waiver

If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

25. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sprout Recovery regarding your use of the Site, and supersede any prior understanding on that subject.
